1. Identity of the company
With orders in our online shop the contract is concluded with: CARDIOWORLD GmbH, Managing Director: Anastasios Tourpouzidis, Erich-Kiefer-Straße 8, 71116 Gärtringen.

2. Conclusion of the contract
The contract is only concluded when an order confirmation is sent to you by e-mail. With your order you make a binding offer to CARDIOWORLD GmbH to conclude the contract with you. The ordering process comprises four steps. In the course of the order process you first enter your customer data and then choose the method of payment and the mode of shipment. In the last step under "Order Control" you have the possibility to check all details (e.g. name, invoice address, delivery address, method of payment, ordered article etc.) once again and to change them if necessary. The order is made by sending us the order form at the end of the step "order control" by clicking the button "buy". You will then receive a confirmation that your order has been received. By sending the subsequent order confirmation, which you will receive within 48 hours after sending your order, CARDIOWORLD GmbH may accept the offer (your order) to conclude a contract.

 

3. Revocation instruction
Consumers are entitled to the following right of revocation, whereby a consumer is any natural person who concludes a legal transaction for a purpose which cannot be attributed to either his commercial or his independent professional activity.   Exercise of the right of revocation You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. In order to exercise your right of revocation, you must inform us at the following address: CARDIOWORLD GmbH, Erich-Kiefer-Straße 8, 71116 Gärtringen, Germany, Tel. +49 7034 252413 | Fax: +49 7034 289 5825, contact@CARDIOWORLD.de by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to revoke this contract. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period. Consequences of the revocation, If you revoke this contract, we shall be obliged to reimburse you for all payments which we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery from the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive the notification of your revocation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund. We may refuse to make a refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier. You must return or hand over the Goods to CARDIOWORLD immediately and in any event no later than within fourteen days from the date you notify us of the cancellation of this Agreement. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the fourteen day period. You shall bear the direct costs of returning the Goods. You shall only be liable for any loss of value of the goods if such loss of value is due to handling of the goods which is not necessary to examine their condition, properties and functioning. Return costs Our service: Returns remain free of charge for you. From an individual goods value of € 450, - we take over the return shipping costs for orders within Germany. Financed transactions If you finance this contract through a loan and later revoke it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is to be assumed in particular if we are your lender at the same time or if your lender makes use of our cooperation with regard to the financing. If the loan has already accrued to us when the revocation becomes effective or when the goods are returned, your lender will enter into our rights and obligations from the financed contract in relation to you with regard to the legal consequences of the revocation or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you want to avoid a contractual obligation as far as possible, make use of your right of revocation and also revoke the loan agreement if you also have a right of revocation for this. If you are an entrepreneur within the meaning of § 14 of the German Civil Code (BGB) and are acting in your commercial or self-employed capacity when concluding the contract, the right of revocation does not apply.   for the delivery of audio or video recordings (e.g. CDs and DVDs) or of software, if the delivered data carriers have been unsealed by you - for the delivery of newspapers, journals and magazines, unless the consumer has made his contractual declaration by telephone.

4. Storage of the contract text
Your order and the order data entered by you will be stored by us. We will send an order confirmation with all details to the e-mail address you have entered. You also have the possibility to set up a shopping account with us. Your order with all entered order data will then be stored in your personal customer account under "Log-in"". Here you can view and print out your order with all your details at any time. You also have the possibility to print out both the General Terms and Conditions and your order with all entered data during the ordering process.

5. battery regulation
In connection with the sale of batteries and rechargeable batteries, we are obliged as a dealer according to the battery regulation to inform our customers of the following:   You are legally obliged to return batteries and rechargeable batteries. As a final consumer, you can also return batteries and rechargeable batteries from our product range free of charge at our sales outlet. You can also return the batteries and accumulators to a municipal collection point or to a local dealer. Batteries and rechargeable batteries that contain harmful substances are marked with the symbol of a crossed-out dustbin and the chemical symbol of the respective harmful substance (e.g. "Cd" for cadmium, "Pb" for lead, "Hg" for mercury).

6. Packaging Ordinance from 2009
The obligation to provide information pursuant to Section 6(1) of the Packaging Ordinance does not apply pursuant to Section 6(3) of the Packaging Ordinance, since CARDIOWORLD GmbH Sportgeräte participates in a system which guarantees the collection of used sales packaging from private final consumers or in their vicinity in a sufficient manner throughout the country.

7. Data protection
CARDIOWORLD GmbH respects your privacy. For this reason, personal data are only collected in the context of shop orders and e-mail forms, whereby the input of personal or business data is expressly voluntary. These data will be processed and stored in accordance with the German data protection regulations and only to the extent necessary for processing your request. Upon request, we will inform you without culpable hesitation, in accordance with applicable law, whether and what personal data about you is stored by us. When you visit our web pages, the name of your Internet browser, the web pages you visit on our site and the date and duration of your visit are regularly saved by our web server. Under no circumstances will the data be passed on to third parties.

8. Use of Google Analytics
This website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website (including your IP address) is transferred to a Google server in the USA and stored there. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties if this is legally required or if third parties process this data on behalf of Google. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you agree to the processing of the data collected about you by Google in the manner described above and for the aforementioned purpose. The collection and storage of data can be contradicted at any time with effect for the future. In view of the discussion about the use of analysis tools with complete IP addresses, we would like to point out that this website uses Google Analytics with the extension "_anonymizeIp()" and therefore IP addresses are only further processed in a shortened form in order to exclude direct personal reference.
